Article 1 - Definitions
1.1 The Carriage Agreement: An agreement for the transportation by coach of one or more persons with or without their baggage, not constituting a travel agreement as defined in section 1.4.
1.2 The Carrier: The entity responsible for providing the carriage under section 1.1.
1.3 The Client: The Carrier's contractual counterparty in the carriage agreement.
1.4 The Travel Agreement: An agreement wherein a travel agent organizes a coach travel arrangement for the counterparty, which includes an overnight stay or exceeds a period of 24 hours, along with at least two of the following services: a) carriage, b) accommodation, or c) a significant additional tourist service.
1.5 The Travel Agent: The entity offering fully organized coach travel arrangements to the public or groups under its own name.
1.6 The Traveller: The person transported by the Carrier or the person entitled to travel within the framework of a travel agreement.
Article 2 - Formation of the Agreement
2.1 The Carrier or Travel Agent may revoke any offer, even if a timeframe for acceptance is provided. An offer becomes binding only upon explicit confirmation by the Carrier or Travel Agent within eight working hours of receipt of the acceptance.
2.2 Any party contracting on behalf of a third party is jointly and severally liable for all resulting obligations, while each Traveller remains responsible for their portion of the agreement.
Article 3 - Prices
3.1 Unless agreed otherwise, fares exclude Dutch VAT and other government-imposed taxes or charges.
3.2 The Carrier may increase fares due to rising costs (e.g., fuel, wages) by adding a surcharge; the Client has the right to reject the increase under sections 6.2 and 6.3.
3.3 The Travel Agent may adjust travel arrangement costs up to 20 days before departure due to increased expenses or currency exchange rates, with the Traveller entitled to reject the increase.
3.4 The Client must cover any extra costs incurred from additional driving distances or hours beyond the agreed fare, as well as any modifications to the carriage or travel arrangement.
Article 4 - Payment and Rights
4.1 The Carrier may request a deposit or full prepayment, due 14 days before departure unless otherwise specified. Failure to pay may result in cancellation and a compensatory fee of at least 30% of the fare.
4.2 Any outstanding fare balance is due within 14 days of the invoice date.
4.3 The Traveller must pay 30% of the travel arrangement costs upon entering the travel agreement, with the remaining balance due four weeks before the start date.
Article 5 - Cancellations
5.1 If the Client cancels the carriage agreement, compensation applies:
22+ days before departure: 15% of fare, minimum €35
21-14 days before departure: 30% of fare
14-2 days before departure: 50% of fare
1 day before or day of departure: 75% or full fare, respectively.
5.2 The Traveller must compensate for cancellations according to the terms, up to the full cost of the travel arrangement for cancellations made on the departure date.
Article 6 - Amendments to Agreements
6.1 The Carrier or Travel Agent may amend the agreement for urgent reasons, informing the Client promptly.
6.2 The Client may reject amendments within the earliest reasonable timeframe, or the rejection becomes void.
Article 7 - Termination Due to Poor Bookings or Force Majeure
7.1 The Travel Agent may terminate the travel agreement if the minimum booking threshold isn’t met, provided the Traveller is notified promptly.
7.2 The Carrier may terminate agreements due to force majeure (e.g., strikes, severe weather). The Client or Traveller may receive a refund proportionate to any portion of the arrangement not provided.
Article 8 - Limitation of Liability
8.1 The Carrier’s liability for Traveller injury or loss of baggage during carriage is limited to the statutory amount under Dutch Civil Code 8:1157.
8.2 The Travel Agent’s liability, excluding cases of intentional harm or negligence, is capped at three times the cost of the travel arrangement.
Article 9 - Traveller Obligations
9.1 Travellers must comply with the Carrier’s or Travel Agent’s instructions, bring valid identification, and label all baggage. Hazardous items are strictly prohibited.
9.2 The Carrier may refuse carriage to Travellers who violate these obligations, without refund.
Article 10 - Camera Monitoring
CCTV monitoring may be used in coaches to ensure safety, in accordance with Dutch privacy laws.
Article 11 - Complaints
11.1 Any complaints regarding service must be communicated to the Carrier or Travel Agent immediately.
11.2 Formal complaints must be submitted within one month of the agreement’s execution or planned departure date, for resolution via a binding decision.
Article 12 - Applicable Law
12.1 Dutch law applies to all agreements with Rentabus.com, with disputes subject to the jurisdiction of Dutch courts.
